The Wichita Eagle/Kansas.com Shocker Ticket Giveaway Official Rules

No Purchase Necessary. A purchase will not increase your chances of winning.

ELIGIBILITY. The Wichita Eagle/Kansas.com Shocker Ticket Giveaway (“Ticket Giveaway”) is open to all current legal residents of the State of Kansas at the start of the Ticket Giveaway (“Entrants”). Ticket Giveaway is sponsored by The Wichita Eagle, a division of Wichita Eagle and Beacon Publishing Company, Inc., 825 E. Douglas Avenue, Wichita, KS 67202 (“Sponsor”). Void where prohibited by operation of law. Employees, officers and directors of The Wichita Eagle and The McClatchy Company, and their immediate family members (defined as spouse, mother, father, sisters, brothers, sons, daughters, uncles, aunts, nephews, nieces, grandparents and in-laws, regardless of where they live) and those living in their household (whether or not related), and each person or entity connected with the production or administration of the Ticket Giveaway, and each parent company, affiliate, subsidiary, agent and representative of any aforementioned entity, are not eligible.

TICKET GIVEAWAY PERIOD. The Ticket Giveaway begins on Wednesday, December 11, 2013, at 12:01 AM Central Time (“CST”), and ends on Friday, December 20, 2013, at 5 PM CST (“Ticket Giveway Period”). During the Ticket Giveaway Period, Sponsor will conduct one (1) Ticket Giveaway, and all entries must be submitted by December 20, 2013.

HOW TO ENTER. Each person may enter three times per day for each of the 10 days of the Ticket Giveaway. You may enter once each day through each of three methods described below, for a total of three entries a day. Once you’ve found any or all of the three daily codes in the locations described below, go to www.kansas.com/shockertickets to enter them. Register for an account, or log in if you are already registered.

(1) Find a code in the print edition of The Wichita Eagle. Each day, a new code will be printed in a promotion ad in The Wichita Eagle from Dec. 11 through Dec. 20. (Daily papers are available to look for the code at no charge in the lobby of The Wichita Eagle, 825 E. Douglas, from 8 a.m. to 5 p.m. Monday to Friday, or at the main branch of the Wichita Public Library.)

(2) Find a code at www.kansas.com. Each day, a new code will be posted on Kansas.com. Follow the link from the home page to find the code.

(3) Find a code in the Shockwaves app. Each day, a new code will be published within a Contest section on the Shockwaves app. You can download the app for tablet or phone in Google Play and Apple’s App Store.

All contact information provided must be valid, current and complete. Persons discovered entering under several names or email addresses will be disqualified. Sponsor reserves the right to disqualify false entries or entries suspected of being false. Entries generated by a script, macro or other automated means will be disqualified. In the event a dispute regarding the identity of an individual who submitted an entry cannot be resolved to Sponsor’s satisfaction, the affected entry will be deemed ineligible.

ODDS. Odds of winning depend on the total number of eligible entries received.

DRAWING AND NOTIFICATION. Each qualified entry will be entered into a random drawing for the prize to take place on or about Friday, December 20, 2013.

The Selected Entrant will be notified by phone or email in Sponsor’s discretion. The Selected Entrant will be required to respond (as directed) within 72 hours of attempted notification. The failure to respond to the notification in a timely way may result in forfeiture of the prize and, in such case, Sponsor may randomly select an alternate entrant from among the remaining eligible entries. Selected Entrant may also be sent an affidavit of eligibility / liability / publicity release (“Release”). Except where prohibited by law, Selected Entrant must allow Sponsor to use their name and picture for marketing purposes. The Selected Entrant’s name may be published in The Wichita Eagle, on Sponsor’s websites and social media pages (including on Facebook) and in affiliated publications and/or websites in the form of a first/last name and hometown. Unless restricted by law, the Selected Entrant will be required to complete and return the Release within the time period specified therein. An alternate Selected Entrant may be randomly selected from among the remaining eligible entries if a Selected Entrant: (i) cannot be reached; (ii) fails to obtain all signatures on the Release and to return the documents in a timely manner as required pursuant to these Official Rules; or (iii) cannot accept or receive the prize for any reason. In the event of a dispute about the identity of an entrant, each entry will be declared made by the authorized account holder of the email address submitted at time of entry. Assumed notification by caller ID and any subsequent returned calls do not constitute a winner. Sponsor will not make multiple attempts to contact Selected Entrant.

PRIZES. If eligible under these Rules, Selected Entrant will each receive two (2) tickets to nine (9) Wichita State University men’s basketball games and two (2) tickets to nine (9) Wichita State University women’s basketball games of Sponsor’s descretion. Approximate Retail Value (“ARV”): Six hundred dollars ($600).

Any taxes and any other costs not specifically stated within these Official Rules are the sole responsibility of the Selected Entrant. Selected Entrant is not permitted to substitute the Prize. Prizes are non-redeemable for cash. Selected Entrant not entitled to any surplus between actual retail value of prize and stated ARV and any difference between stated ARV and actual value of the prize will not be awarded. No substitution, transfer or cash redemption of Prize. Selected Entrant is solely responsible for all federal, state and local taxes on Prize and other unspecified expenses related to Prize. All activities related to the Prize are at the Selected Entrant’s own risk and subject to whatever restrictions are imposed by the entities that govern activities. All Ticket Giveaway entries are subject to verification prior to awarding of any prize. Prize must be picked up at The Wichita Eagle, 825 E. Douglas, Wichita, KS  67202, within fifteen (15) days of drawing date.

CONDITIONS. All federal, state or other tax liabilities (including income taxes) arising from this Ticket Giveaway will be the sole responsibility of Selected Entrant. Selected Entrant may be issued an IRS Form 1099 for the ARV of any awarded prize. All warranties are hereby disclaimed, and the Selected Entrant will accept the prize "as is." CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND WILL RESULT IN DISQUALIFICATION FROM PARTICIPATION IN THE SWEEPSTAKES. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY FEES) TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION. Except where prohibited by law, the Selected Entrant's entry and acceptance of the prize constitutes permission for Sponsor to use said winner's full name, photograph, likeness, statements, biographical information, voice, and city and state address for promotional or advertising purposes in connection with these Ticket Giveaway on a worldwide basis, and in all forms of media, now or hereafter known, in perpetuity, without review, permission or further compensation. This Ticket Giveaway is subject to all applicable federal, state and local laws of the United States. By participating, Selected Entrants agree to be fully and unconditionally bound by these Official Rules and the decisions of Sponsor and waive any right to claim ambiguity in the Ticket Giveaway or these Official Rules. Selected Entrants also agree to release, discharge, indemnify and hold harmless Ticket Giveaway Entities and each of their respective officers, directors, employees, representatives and agents (“Releasees”) from and against any claims, damages, disability, attorneys' fees, and costs of litigation and settlement, as well as any liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from redemption, acceptance, possession, ownership, misuse or use of any prize or participation in any Ticket Giveaway-related activity or participation in this Ticket Giveaway. Releasees shall not be liable to the Selected Entrant for failure to supply any Prize or any part thereof, by reason of any acts of God, any action(s), regulation(s), order(s) or request(s) by any governmental or quasi-governmental entity (whether or not the action(s), regulations(s), order(s) or request(s) prove(s) to be invalid), equipment failure, threatened terrorist acts, terrorist acts, air raid, blackout, act of public enemy, earthquake, war (declared or undeclared), fire, flood, epidemic, explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal), labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot, or any other similar or dissimilar cause beyond any of the Releasees’ control. The Releasees shall not be liable for: (i) late, lost, delayed, misdirected, incomplete unreadable, inaccurate, garbled or unintelligible entries, communications or affidavits, regardless of the method of transmission; (ii) telephone system, telephone or computer hardware, software or other technical or computer malfunctions, lost connections, disconnections, delays or transmission errors; (iii) data corruption, theft, destruction, unauthorized access to or alteration of entry or other materials; (iv) any injuries, losses or damages of any kind caused by the prize or resulting from acceptance, possession or use of a prize, or from participation in the Ticket Giveaway; or (v) any printing, typographical, administrative or technological errors in any materials associated with the Ticket Giveaway. Sponsor may prohibit an entrant from participating in the Ticket Giveaway or winning prize if, in its sole discretion, it determines such entrant is attempting to undermine the legitimate operation of the Ticket Giveaway in any way by cheating, hacking, deception, or any other unfair playing practices of intending to annoy, abuse, threaten or harass any other players or Sponsor representatives. Use of any automated system to participate is strictly prohibited and will result in disqualification. Sponsor may disqualify at its sole discretion any entries it believes are created by an automated system.

Sponsor reserves the right, in its sole discretion, to cancel, modify or suspend the Ticket Giveaway should a virus, bug, computer problem, unauthorized intervention or other causes beyond Sponsor’s control, corrupt the administration, security or proper play of the Ticket Giveaway. If the Ticket Giveaway are terminated, Sponsor reserves the right, at its discretion, to select the potential winner(s) in a random drawing from among all eligible, non-suspect entries received prior to action taken.

DISPUTES. Except where prohibited, Entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Ticket Giveaway or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of Kansas. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Ticket Giveaway, shall be governed by, and construed in accordance with, the laws of the State of Kansas, without giving effect to any choice of law or conflict of law rules (whether of the State of Kansas or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Kansas.

PRIVACY. All personal information collected by Sponsor will be used for administration of the Ticket Giveaway. In addition, entrants shall receive email correspondence from or on behalf of the Sponsor, subject to the Sponsor’s privacy policy. Sponsor uses reasonable commercial efforts to comply with federal CAN-SPAM guidelines, and entrants may subsequently opt-out of receiving further emails by following the opt-out instructions contained in the email. WINNER’S LIST AND SWEEPSTAKES RULES. To obtain a copy of these official rules or the winner’s name within 90 days of the close of the Ticket Giveaway, send your request and a self-addressed stamped envelope to: The Wichita Eagle, Ticket Giveaway, 825 E. Douglas, Wichita, KS 67202. Selected Entrant’s name will be sent once Selected Entrant has been verified and prize has been awarded. All requests must be received within 90 days of the end of the Sweepstakes Period.
